PHD Title

The logical direction of Aby Hanifa al-Noaman and its impact upon the development of the principles of Islamic Jurisprudence

PHD Abstract

This thesis "The logical direction of Aby Hanifa al-Noaman and its impact upon the development of the principles of Islamic Jurisprudence" is primarily concerned with analyzing some of the logical principles of Imam Abu Hanifa al-Noaman's doctrine, regarding the interpretation of the religious text by stating the effects of this method in Islamic jurisprudence. The study focused on the logical patterns in the attempts of Imam Aby Hanifa jurisprudence, also revealed the estimated jurisprudence of the Imam or the so-called probability logic, where the jurisprudence is estimated in some jurisprudential images which are related to legitimate judgments regarding the future, which contributed greatly to the development of Islamic jurisprudence. Therefore, the study concerned with the method of Imam Aby Hanifa in presenting his jurisprudential issues in a manner in which the researcher was able to draw their symbolic images in the form of mathematical equations that show that there is a correlation between the logic and the fundamentals of jurisprudence in the context of his statements. The study also described the elements of the explanatory method he had in following his method of induction and reasoning. His method was to raise the issue of fiqh in a branch and to search for it and reach a rule from which to derive a general rule. The thesis consists of the following: Chapter One: "Logic of Ijtihad and tradition in the jurisprudence of Aby Hanifa". Chapter Two: "perceptions and ratifications in the words of Imam Aby Hanifa". Chapter Three: "Issues of reasoning between logic and attempts in the jurisprudence of Imam Aby Hanifa". Chapter Four: "Finally, the fourth chapter is entitled: "Rational attempts of Imam Aby Hanifa and its impact on the development of the Islamic jurisprudence". We have concluded that the thought of Imam Aby Hanifa revolves in three directions: The first is the puritanical direction of the texts of the Qur'aan and Sunnah and the knowledge of the provisions of the words and the issues mentioned therein in clear fundamentalist ways. The second is the rational attitude, which revolves around the scope of ijtihad, research and development in the fundamentals of Shari'a, and the reasoning of judgments in which there are no explicit texts or other similar issues in the Quran or the Sunnah. This is evident in esoteric methods of jurisprudence, legal tricks, and approbation. The third is the direction in which Abu Hanifa activated the role of reason in the textual evidence, which we can call the "Shari'a judgment in the light of textual and reasonable". This is the way in which Imam Abu Hanifa managed to devise some Shari'a judgments in a rational way through the Qur'an and Sunnah ad to this the understanding of the vocabulary of the language and its implications for some of the real dilemmas and issues, using the measurement of all types (exceptional and contractual).
